10.2. Frequency of Collection: Location data is collected at regular intervals, typically every 30 to 120 seconds, while the driver is on duty or actively using location-enabled features. The collection frequency may vary based on movement, battery optimization settings, and network conditions.

10.3. How We Use Location Data: We use location data to:

  • Provide real-time shipment tracking to dispatchers and authorized customers
  • Calculate and update estimated arrival times (ETAs)
  • Generate proof of delivery (POD) and pickup confirmations with location verification
  • Monitor route compliance and optimize routing
  • Support Electronic Logging Device (ELD) requirements and Hours of Service compliance
  • Enable time clock functionality with location-verified clock-in/clock-out
  • Create operational reports and analytics
  • Detect and prevent fraudulent activity
  • Trigger automated notifications for arrivals and departures
  • Support safety monitoring and emergency response

10.4. Background Location Collection: The TraxQ mobile application may collect location data while running in the background. This enables continuous tracking during active loads without requiring the app to remain in the foreground. Background location collection can be disabled through your device settings, but this will limit tracking functionality.

10.5. Location Data Sharing: Location data may be shared with:

  • Your Employer/Company: Dispatchers, fleet managers, and administrators within your organization
  • Customers (Shippers/Brokers): Third parties authorized to view shipment tracking via tracking links or customer portal
  • Service Providers: Map providers (OpenStreetMap, Nominatim) for geocoding and routing
  • Regulatory Agencies: When required for FMCSA, DOT, or other regulatory compliance
  • Law Enforcement: When legally compelled or to protect safety

10.6. Location Data Retention: Location history is retained for operational purposes and regulatory compliance. FMCSA requires certain location-related records (including ELD data) to be retained for 6 months. We may retain location data for longer periods for analytics, dispute resolution, and legal purposes. You may request deletion of historical location data subject to our retention policies and legal obligations.

11. Customer Tracking Portal and Public Tracking Links

11.1. Tracking Portal Features: TraxQ provides a customer-facing tracking portal that allows authorized third parties to view shipment status and location. Information displayed on the tracking portal may include:

  • Current shipment location (last known or real-time)
  • Estimated arrival time (ETA)
  • Shipment status (pickup, in transit, delivered)
  • Origin and destination cities
  • Driver name (if configured to display)
  • Truck/trailer information (if configured)
  • Delivery confirmation and proof of delivery images

11.2. Public Tracking Links: When you generate and share a tracking link, anyone with access to that link can view the information configured for display. Tracking links do not require authentication. You are responsible for sharing tracking links only with authorized parties and should treat them as sensitive information.

11.3. Tracking Portal Chat: The tracking portal includes a chat feature allowing customers to communicate with your dispatchers. Chat messages are stored and associated with the load record. Chat messages may include metadata such as IP addresses and timestamps.

11.4. Configuration Options: You can configure what information is displayed on tracking links through your account settings. We recommend reviewing your tracking visibility settings to ensure only appropriate information is shared with customers.

12. Cookies, Web Beacons, and Tracking Technologies

12.1. Cookies We Use: We use cookies and similar tracking technologies to collect and track information and to improve and analyze our Service. Types of cookies we use include:

  • Essential Cookies: Required for the Service to function properly, including authentication, session management, and security

  • Obtaining appropriate consents where required by law
  • Ensuring you have a lawful basis for collecting and processing driver/employee data
  • Responding to data access, correction, or deletion requests from your drivers/employees

22. "Do Not Track" Disclosure

Some web browsers transmit "Do Not Track" (DNT) signals to websites. Because there is no common understanding of how to interpret DNT signals, TraxQ does not currently respond to or alter its practices when it receives DNT signals from visitor browsers. We will continue to monitor developments around DNT browser technology and may update this policy if a consensus emerges on how to handle such signals.

23. Automated Decision-Making and Profiling

23.1. Automated Processes: We use automated systems for certain functions, including:

  • ETA calculations based on GPS location and route data
